Terms of Service

1. Acceptance of Terms
Welcome to Haven ("Haven," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Haven mobile application, website at haven.dating, and all related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater);
- Be legally able to enter into a binding contract with Haven;
- Not be prohibited from using the Service under the laws of the United States or any other applicable jurisdiction;
- Not have been previously banned or removed from the Service;
- Not be a registered sex offender in any jurisdiction;
- Comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
By using the Service, you represent and warrant that you meet all eligibility requirements. We may, in our sole discretion, refuse to offer the Service to any person or entity and change eligibility criteria at any time.
3. Account Registration
3.1 Account Creation
To access certain features of the Service, you must create an account. You may register using Apple Sign In, email, or Google Sign In. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. Haven will not be liable for any loss or damage arising from your failure to safeguard your account.
3.3 One Account Per Person
Each person may maintain only one Haven account. Creating multiple accounts may result in the termination of all your accounts.
4. User Conduct and Content
4.1 Your Content
You are solely responsible for the content you post, upload, or share on the Service, including photos, text, messages, and any other materials ("User Content"). By posting User Content, you grant Haven a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and providing the Service.
4.2 Content Standards
You agree that your User Content and conduct will not:
- Violate any law or regulation;
- Be fraudulent, false, misleading, or deceptive;
- Infringe on any third party's intellectual property rights;
- Contain any material that is defamatory, obscene, harassing, threatening, or hateful;
- Promote discrimination, bigotry, racism, hatred, or harm against any individual or group;
- Promote violence or actions that are threatening to any other person;
- Contain any unsolicited advertising, promotional materials, or spam;
- Contain any viruses, malware, or other harmful code;
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
- Solicit personal information from minors;
- Involve commercial activities without our prior written consent, including contests, sweepstakes, or advertising;
- Involve the transmission of "junk mail," "chain letters," or unsolicited mass mailing.
4.3 Explicit Content
Haven allows certain adult content that users can opt into viewing. Explicit content is hidden by default and must be actively enabled in settings. All explicit content must be consensual, legal, and must not depict minors under any circumstances. Haven reserves the right to remove any content and suspend or terminate accounts that violate these standards.
4.4 Content Moderation
Haven reserves the right, but is not obligated, to monitor, review, and remove User Content at our sole discretion and without notice. We may use automated systems and human review to detect content that violates these Terms or our Community Guidelines.
5. Interactions with Other Users
5.1 Personal Responsibility
You are solely responsible for your interactions with other users of the Service. Haven does not conduct criminal background checks on its users. Haven makes no representations or warranties as to the conduct, identity, intentions, legitimacy, or veracity of any user. Haven reserves the right, but has no obligation, to monitor disputes between you and other users.
5.2 Safety
You agree to take reasonable precautions in all interactions with other users, especially if you decide to meet in person. You should not provide financial information or send money to other users. If you feel threatened or believe a user is engaging in illegal activity, please contact local law enforcement and report the user to Haven immediately.
5.3 Reporting and Blocking
Haven provides tools to block and report users who violate these Terms or make you uncomfortable. We encourage you to use these tools to help maintain a safe community. Reports are reviewed by our trust and safety team, and appropriate action will be taken in accordance with our policies.
6. Subscriptions and Payments
6.1 Haven Gold
Haven offers premium subscription plans ("Haven Gold") that provide access to enhanced features. Haven Gold is available as a monthly or annual subscription. Pricing is displayed in the app and is subject to change.
6.2 Billing and Renewal
Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on the plan selected). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. Payment will be charged to your Apple ID account or applicable payment method at confirmation of purchase.
6.3 Cancellation
You may cancel your subscription at any time through your device's subscription management settings (e.g., Settings > Apple ID > Subscriptions on iOS). Cancellation takes effect at the end of the current billing period. You will continue to have access to Haven Gold features until the end of your paid period. No refunds will be issued for partial billing periods.
6.4 Price Changes
Haven reserves the right to change subscription pricing at any time. Price changes will take effect at the start of the next billing period following the date of the price change. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.
6.5 Refunds
All purchases are final and non-refundable, except as required by applicable law. If you believe you are entitled to a refund, please contact Apple Support for App Store purchases or our support team at support@haven.dating.
7. In-App Purchases
Haven may offer additional in-app purchases such as profile boosts and other premium features ("In-App Purchases"). In-App Purchases are non-refundable, non-transferable, and non-exchangeable. Haven may modify, suspend, or discontinue any In-App Purchase at any time without notice or liability.
8. Intellectual Property
8.1 Haven's Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Haven and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8.2 Feedback
Any feedback, comments, or suggestions you provide regarding the Service is entirely voluntary, and we will be free to use such feedback, comments, or suggestions without any obligation to you.
9. Third-Party Services
The Service may contain links to or integrate with third-party services, including but not limited to Apple Music, Firebase, and payment processors. Haven is not responsible for the practices or content of these third-party services. Your use of third-party services is governed by the respective terms and privacy policies of those services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Haven does not warrant that:
- The Service will be uninterrupted, secure, or error-free;
- The results obtained from the use of the Service will be accurate or reliable;
- The quality of any products, services, information, or other material obtained through the Service will meet your expectations;
- Any errors in the Service will be corrected;
- Any user of the Service is who they claim to be.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAVEN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service;
- Unauthorized access, use, or alteration of your transmissions or content;
- Any interactions with other users, whether online or offline;
- Any physical harm, emotional distress, or other damages resulting from your use of the Service or your interactions with other users.
IN NO EVENT SHALL HAVEN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO HAVEN IN THE TWELVE (12) MONTHS PRECEDING THE DATE OF THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Haven and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your interactions with other users.
13. Termination
13.1 Termination by You
You may terminate your account at any time by deleting your account through the app settings or by contacting us at support@haven.dating. Upon termination, your right to use the Service will immediately cease.
13.2 Termination by Haven
Haven may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, fraudulent or illegal activity, behavior that is harmful to other users, or conduct that could create liability for Haven.
13.3 Effects of Termination
Upon termination, your account will be deactivated and your profile will no longer be visible to other users. Haven is not obligated to retain or provide you with copies of your User Content. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
14. Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
14.2 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the State of Florida, and the arbitrator's decision shall be final and binding.
14.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
14.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights. Small claims court actions that qualify may also be brought in the appropriate small claims court.
15. General Provisions
15.1 Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Haven concerning the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15.3 Waiver
The failure of Haven to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
Haven may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer your rights or obligations under these Terms without Haven's prior written consent.
15.5 Notices
Haven may provide notices to you via email, push notifications, in-app messages, or by posting on the Service. You may provide notices to Haven by contacting us at support@haven.dating.
16. Changes to These Terms
Haven reserves the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
